Agents, contractors, funded and sponsored agencies, including non-government and not-for-profit organisations, that undertake work on behalf of Curtin’s community (internal and external) are required to report annually on any actions that help achieve the outcomes in Curtin’s Disability Access and Inclusion Plan. Contracted employees are not considered ‘contractors’ for this purpose.

Curtin agents and contractors
If you are a Curtin agent or contractor please read the Agent and Contractor Progress Report. This report is required by 31 May each year.
If you are responsible for managing contracts that relate to Curtin’s buildings and facilities, information technology or events, you are required to:
Refer contractors to the above Agent and Contractor Progress Report form and ensure they complete and deliver it by 31 May
Complete the highlighted sections of the below DAIP Reporting form and fax or email to Manager DAIP Implementation by June 15 each year
Section 29B of the Disability Services Act (WA) 1993 states “A public authority that has a disability access and inclusion plan must take all practicable measures to ensure that the plan is implemented by the public authority and its officers, employees, agents or contractors”.
This requirement is also found on Curtin’s policy page under Procurement Procedures 3.2.6(a)(b) and in the Contract Toolkit (see Attachment F, p. 19, and Attachment J, p. 30).
In accordance with S29, a special condition clause is required which:
Applies only to ‘relevant’ new contracts or contract variations in the reporting year
Applies to services provided to the public
Does not apply to services provided directly to the public authority itself, such as cleaners or rewiring of telephones
In agreeing to the special condition, the agent or contractor agrees to:
Undertake the contract in a manner consistent with Curtin’s DAIP
Provide an annual report to Curtin about DAIP Outcome areas their activities have supported
Curtin Clause for insertion in ‘relevant’ contracts:
DISABILITY ACCESS AND INCLUSION PLAN
(i) To the extent practicable, implement Curtin’s “Disability Access and Inclusion Plan” prepared under the Disability Services Act (WA) 1993; and
(ii) Provide Curtin with relevant reports that are required in accordance with the Disability Services Act (WA) 1993 as amended to the extent to which they are applicable under the terms of this agreement.
A link to Curtin’s Disability Access and Inclusion Plan should also be included in the contract.
Note: If unsure whether a contract is relevant, please follow the intent of the DSA legislation i.e. that contracted services are accessible to people with disability.

“The Disability Services Act (1993) requires Curtin University to have a Disability Access and Inclusion Plan (DAIP). The DAIP is to be implemented not only by Curtin staff, but also by its agents and contractors who provide services to the public on its behalf.
Curtin contractors are required once a year, to provide a brief list of activities undertaken to support the Curtin DAIP. To avoid delays in processing the information would you please complete the attached form and return it to Manager DAIP Implementation as soon as possible, but no later than 31 May.
